2. Website Purpose
The website provides information, educational resources, speaking information, consulting and coaching enquiry channels, media information, events information, and related content concerning mental health, faith, leadership, personal growth, and community wellbeing.
The website is intended for adults aged 18 and over. It is not designed for children.
3. No Medical, Mental-Health, Legal, or Emergency Service
Website content is provided for general educational and informational purposes. It is not medical, psychiatric, psychological, therapeutic, diagnostic, legal, financial, or crisis advice.
Use of this website does not create a therapist-client, doctor-patient, counsellor-client, legal adviser-client, coaching-client, pastoral-care, or other professional relationship unless a separate written agreement expressly states otherwise.
Do not use this website for emergencies, crisis support, diagnosis, treatment, or urgent mental-health concerns. If you or another person may be in immediate danger, contact local emergency services or a qualified emergency or crisis-support provider in your location.
4. Enquiries, Speaking, Consulting, and Coaching
Submitting an enquiry does not create a booking, service agreement, or obligation for either party. A speaking, consulting, coaching, training, media, or partnership engagement is confirmed only when the relevant parties agree in writing to the scope, fees, dates, deliverables, and applicable terms.
We may accept, decline, or request further information about an enquiry at our discretion.
5. Events, Registrations, and Future Payments
Where events, workshops, masterclasses, or paid services are offered, the applicable event page, proposal, invoice, registration page, or separate service agreement may include additional terms, including pricing, payment schedules, cancellation, refund, attendance, conduct, recording, intellectual-property, and rescheduling terms.
If online payments are introduced, they may be processed through Stripe or another disclosed payment provider. You are responsible for providing accurate payment information and complying with that provider’s terms.
Unless separate written terms state otherwise, no payment, booking, or service is confirmed merely because an enquiry has been submitted.
6. Intellectual Property
Unless otherwise stated, the website and its content—including text, articles, graphics, logos, brand elements, images, videos, audio, downloads, designs, and other materials—are owned by or licensed to Dr. David Rex Orgen and are protected by applicable intellectual-property laws.
You may view, download, and print content for personal, non-commercial use only, provided that you do not remove copyright, branding, or proprietary notices.
You may not, without prior written permission:
- Copy, reproduce, republish, sell, license, distribute, or commercially exploit website content;
- Modify or create derivative works from protected material;
- Use our name, logo, imagery, or materials in a misleading, defamatory, or unauthorised way;
- Use automated scraping, extraction, or harvesting tools except where permitted by applicable law;
- Present our content as your own or imply endorsement, affiliation, or sponsorship.
7. Acceptable Use
You agree not to use the website to:
- Violate any law or another person’s rights;
- Submit false, misleading, unlawful, abusive, defamatory, or harmful material;
- Introduce malware, code, or content designed to disrupt, damage, or gain unauthorised access to systems;
- Interfere with the website’s security, availability, or normal operation;
- Attempt to access areas, data, or systems that you are not authorised to access;
- Use the website for unsolicited marketing, spam, or fraudulent activity;
- Upload or transmit sensitive personal-health information through ordinary website forms.
We may suspend or restrict access where we reasonably believe these Terms have been violated.
8. Third-Party Links and Services
The website may link to third-party websites, social platforms, maps, payment processors, podcast services, event platforms, or other services. These links are provided for convenience only.
We do not control and are not responsible for third-party content, availability, privacy practices, security, products, services, or terms. Your use of a third-party service is governed by its own policies and terms.
9. Accuracy and Availability
We aim to keep website information accurate and current, but we do not guarantee that all content is complete, current, error-free, or suitable for every purpose. We may change, suspend, or remove content, features, events, or resources at any time without notice.
We do not guarantee uninterrupted, secure, or error-free website access. You are responsible for using appropriate security measures and maintaining backups of information you choose to submit or retain.
10. Disclaimer of Warranties
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise.
This includes, to the extent permitted by law, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and availability.
Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
11. Limitation of Liability
To the fullest extent permitted by law, Dr. David Rex Orgen and related representatives will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, opportunity, or business, arising from or related to your use of, inability to use, or reliance on the website or its content.
Where liability cannot lawfully be excluded, our aggregate liability for claims relating to the website will be limited to the greater of: (a) the amount you paid to us specifically for the relevant website-based service during the 12 months before the claim; or (b) US $100.
Some jurisdictions do not allow certain limitations. In those jurisdictions, liability is limited only to the extent permitted by law.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Dr. David Rex Orgen and related representatives from claims, liabilities, damages, losses, and expenses arising out of your unlawful use of the website, violation of these Terms, or infringement of another person’s rights.
13. Suspension and Termination
We may suspend, restrict, or terminate access to the website or an enquiry channel at any time where reasonably necessary to protect the website, users, rights, safety, security, or compliance obligations.
Sections that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute provisions—will survive.
14. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the website, you acknowledge that you have read that Policy.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-law principles.
Before filing a formal claim, you agree to contact us at info@davidorgenauthor.com and attempt in good faith to resolve the issue informally for at least 30 days.
Subject to applicable consumer-protection law, any legal action arising out of or relating to these Terms or the website must be brought in the state or federal courts located in Ohio, and you consent to the jurisdiction and venue of those courts.
Nothing in this section limits any non-waivable consumer rights you may have under the law where you live.
16. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the website after changes take effect means that you accept the updated Terms, to the extent permitted by law.
